Probable Cause

On October 1, 2018 Narcotics Investigators received information regarding marijuana being in a bedroom at a residence in Merrifield, Crow Wing County, Minnesota. The bedroom belonged to Jason Scott Staley, D.O.B. 10/21/1999, hereinafter "defendant." Law enforcement arrived at the residence and were allowed entry by a resident.

Deputy Henderson identified himself to defendant and indicated he needed to speak with defendant regarding narcotics and drug paraphernalia in his bedroom. Deputy Henderson then followed defendant to his bedroom to speak with him. Defendant admitted he rents a room from the owner of the residence and that he had a marijuana bong and grinder in his room. Defendant admitting having approximately a "quad" of marijuana. Defendant initially agreed to consent to search his bedroom and vehicle but then rescinded his consent. Law enforcement then drafted a search warrant which was granted for defendant's bedroom and vehicle.

The following items were located in defendant's bedroom. Located under the bed was a black hard cased suitcase containing multiple bags of suspected marijuana, marijuana paraphernalia and a trace amount of suspected marijuana wax. A black cell phone box with a bag of suspected marijuana was also located. $850.00 cash was located in the closet. The total weight of the marijuana was approximately 152.3 grams, one baggie which weighed approximately 64.4 grams field tested positive for THC.

A digital scale and ziplock baggies were also located as a result of the search warrant.

Defendant admitted to purchasing the marijuana from a subject in Crosby a week prior and purchases marijuana approximately once a month.

A cell phone was taken as evidence during the search. A subsequent search warrant was executed on defendant's cell phone and text messages sent and received in addition to the quantity of marijuana, box of ziplock baggies and digital scale indicate to law enforcement that defendant was actively involved in the sale of controlled substances.
