Probable Cause

Andrew Lee Weiland, dob: 03/21/80, is required by the State of Minnesota to register his address as a predatory offender.

On 08/23/19 at 1527 hours Weiland was arrested for driving after cancellation/inimical to public safety and drug paraphernalia by the Baxter Police Department. On 08/24/19, Weiland completed a predatory offender change of information form in the Crow Wing County Jail updating his employment and listing his address as a residence on Fred Lane in Brainerd, Crow Wing County, MN.

As previously reported on 08/23/19 through 08/25/19, Officer Larson attempted to locate Andrew Weiland and verify his address at his registered address on Fred Lane. Officer Larson interviewed Weiland's former roommate at the Fred Lane address, who reported that Weiland only stayed at the address for a short period of time before he went to jail on August 23, then did not return back to the residence on Fred Lane. Reynolds also confirmed that Weiland did not have any property at Reynolds' residence and that Reynolds has not heard from Weiland. Officer Larson also contacted Weiland's mother, who advised she did not know where Weiland was residing.

Later, on 08/25/19 at 1940 hours, after Officer Larson had spoken with the former roommate and Weiland's mother, Andrew Weiland came to the Brainerd Police Department and requested to be now listed as predatory offender with lack of primary address. Weiland filled out the predatory offender weekly check in form.

It should be noted that Lieutenant Kleffman has informed Weiland on several occasions during previous predatory offender registration violation investigations that when Weiland registers as being homeless, he must report to law enforcement every week as a check in. Weiland has acknowledged this on several occasions including the last time Kleffman arrested him for predatory offender registration violation as a result of not checking in for the weekly homeless check in.

On 09-17-19, at approximately 1236 hours, Andrew Lee Weiland, dob/032180, came to the Brainerd Police Department to conduct a weekly, “Lack of a primary address” check-in, as Weiland is a registered predatory offender that has registered himself as homeless. A predatory offender who is homeless is required to come to a law enforcement agency every seven days for a, “Weekly check-in.”

Investigator Runde was called to the Brainerd Police Department front desk to conduct a weekly check-in on Andrew Weiland. Runde reviewed Weiland's current status in the in-house computer and found that Weiland's last weekly check-in that Weiland conducted was on 09-07­19, which would have Weiland required to conduct a weekly check-in on 09-14-19.

It should be noted, Investigator Runde is aware that Weiland does have an extensive history of not being in compliance with his predatory offender registry. On 09-17-19, Investigator Runde met with Weiland at the front entrance of the Brainerd Police Department. Runde did activate a body worn camera and made contact with Weiland, along with Officer Kostreba. Runde asked Weiland where he has been. Runde advised Weiland that he is three days late from his weekly check-in. Weiland at this point admitted that he was, “Only two days late,” and stated he, “Tried to call.” It should be noted there is no documented incident report in which Weiland had called and made contact with an officer regarding his weekly check-in. If he had called, and ICR would have been created.

Weiland has a POR violation conviction from December, 2015 in 18-CR-15-507 and another in 2006.
