Probable Cause

On October 3, 2015, Breezy Point City Police Officers and Pequot Lakes City Police Officers were looking for Michael Lowell Munger, the above-named defendant, to speak with him about a possible Order for Protection violation. Officers were aware that the defendant was driving a 1996 Toyota bearing Minnesota license plate number 074RVK. At approximately 1847 hours, Breezy Point City Police Officer Jay Lorch observed the defendant turn into Billy's Bar and Grill in Breezy Point, Minnesota, park his vehicle and walk away from it. Officer Lorch subsequently observed the defendant walk out of the bar, come and get into the vehicle and leave the parking lot. Officer Lorch lost sight of the defendant's vehicle going around a curve.

At approximately 1900 hours, Pequot Lakes City Police Officer Matthew Jorgens was stationary on Crow Wing County Road 11 near the Peterson Road when he observed a vehicle traveling at what appeared to be a very high rate of speed. Officer Jorgens radar clocked the vehicle at a speed of 66 mph in 55 mph speed zone but lost sight of it going around a corner and then observed a large dust cloud on the west entrance of Peterson Road. Officer Jorgens knew that the road immediately turned back onto County Road 11 so he turned around and entered from the other side and located the Toyota pulled over on the side of the road.

Officer Jorgens made contact with the driver, the defendant, who stated that he knew he was speeding and probably did not have insurance on the vehicle. The defendant indicated that he just panicked when he saw a Breezy Point squad car following him. Officer Jorgens verified that the defendant's automobile insurance policy had been canceled on July 11, 2015.

Breezy Point City Police Officer Jay Lorch arrived at the scene and began to speak with the defendant about the Order for Protection. The defendant denied violating the Order for Protection but said that the protected party should know better than to "poke a bear". The defendant also made a comment that the protected party was "going to bring this on herself". Officer Lorch asked the defendant what he meant but the defendant would not answer that question and said that he knew what Officer Lorch was trying to do.

The defendant seemed angered by Officer Lorch's question and stated that he was going to have to "look you up" referring to Officer Lorch. The defendant also asked Officer Lorch if he had a wife and kids. The defendant said "we should meet some time when you're off duty". When Officer Lorch told him that was not going to happen, the defendant replied, "you're not as dumb as you look". The defendant then asked Officer Lorch if he knew what a cops goal was every night, like he was referring to going home alive at the end of the shift. Officer Lorch told the defendant he did not know the answer and asked him what it was. The defendant said it Officer Lorch did not know the answer he should not be an officer. Officer Lorch felt threatened by the defendant's statements and felt that the defendant was trying to intimidate him.
