Probable Cause
Brainerd officers were dispatched to an assault at 1306 Quince Street, Brainerd, Crow Wing County on 8/19/2021 at approximately 2053 hours. S.E.N., reported that she went to Jesse Scott Martini's, dob 8/30/1983, residence to gather the remainder of her property and he locked the door so she couldn't leave and assaulted her. Officer Gleason spoke with S.E.N. at her residence on Rosewood Street directly across the alley of Martini's residence. S.E.N. said she went over to Martini's residence to gather some of her belongings because she used to live there. S.E.N. is the protected party of a DANCO in which Martini is prohibited from having any contact with S.E.N. The DANCO was issued on November 25, 2020 in court file 18-CR-20-3943. The DANCO was issued after Martini was alleged to have assaulted S.E.N. Martini is also charged with a domestic assault in file 18-CR-20-3603 for assaulting S.E.N. in October 2020. Since the issuance of the DANCO, Martini has been charged with violating the DANCO in four other matters, and with assaulting S.E.N. in two of those pending matters. See, 18-CR-21-594; 18-CR-21-712; 18-CR-21-2402; and 18-CR-21-2651. All matter are pending.
In this matter, Martini had told S.E.N. that she could come over to his residence to get her belongings. S.E.N. was in the kitchen when Martini began to, "Go crazy." Martini ran to the back door and locked it. Martini began to fear that S.E.N. was going to run to the front door and he locked that as well. S.E.N. said she scared and was going to call 911. Martini attempted to take S.E.N.'s phone out of her hand. S.E.N. held onto her phone. Martini picked S.E.N. up and slammed her on the ground. S.E.N. continued to hold onto her phone. Martini picked S.E.N. up and slammed her against the floor again. S.E.N. hit her head during the altercation. S.E.N. was able to get out of the residence after Martini took her phone. S.E.N. had small scratches on her legs and arms and her pants were ripped in two places due to the altercation. S.E.N. did not think she had any visible injuries on her head and did not request any medical assistance. S.E.N. said her phone is worth approximately $799.
Martini had left his residence before officers arrived. Martini later returned to the residence at approximately 2240. Martini was observed parking his vehicle in the front of his residence at on Quince Street. Martini exited the car Sergeant Rosier advised Martini Officer Middleton needed to speak with him. As Middleton walked around the front of the car Martini got back in the front seat and locked the front door. Rosier opened the back passenger door unlocked the driver's door Middleton opened the driver's door and heard Rosier advised Martini he is under arrest and to get out of the car. Martini said, "fuck you" and clinched his fist and leaned back towards the passenger seat, Middleton grabbed Martini's left arm, Martini pulled away from Middleton. Martini was shouting what am I being arrested for Middleton advised Martini he was under arrest for domestic assault. Martini continued to pull away from officers. Rosier advised Martini he would be sprayed with mace if he did stop resisting. Martini continued to resist and pull away as Middleton was trying to grab his arm. Martini then climbed over to the passenger's seat and exited the vehicle. Martini continued to resist by locking his hand together and laying while lying on his stomach. A few moments later other officers arrived on scene and help secure Martini in handcuffs. An open can of beer was located in Martini's vehicle along with a glass smoking pipe with a white crystal like substance. A second pipe typical used to smoke marijuana. Once at the jail officer E Gleason called S.E.N.'s missing cell phone so that it would ring and S.E.N. could locate it. S.E.N. found the cell phone in a pile of pallets located in Martini's driveway. |
