Probable Cause

On 2/19/19, Officer Larson attempted to do a compliance check on a predatory offender named T.E.A. Officer Larson attempted to call Aleman on his listed phone number and was unable to get in contact with Aleman.
Officer Larson then went to Aleman's listed residence according to the predatory offender registration website. That residence was 130 Kelley Rae Road in Brainerd. Officer Larson knocked on the door, and the door was answered by L.M.C.. L.M.C. stated to Officer Larson that Aleman did not live there anymore, and he had not lived there in approximately one month.

Officer Larson went back to the office and confirmed on the predatory offender registration website that 130 Kelley Rae Road was the most recent address Aleman had listed. Officer Larson called two of the emergency contacts listed on Aleman's profile of the predatory offender registration website. Officer Larson did not receive an answer or call back from the first contact who was listed as Aleman's girlfriend, but Officer Larson did get hold of Aleman's sibling who stated she would get in contact with Aleman and have him call Officer Larson.

Officer Larson went back to 130 Kelley Rae Road to get a statement from L.M.C.. Officer Larson went back and spoke with L.M.C. and got a statement which will be attached to this incident. L.M.C. stated to Officer Larson that after Stearns County did a search warrant related to Timothy Aleman in regards to some stolen property, the owner of the trailer kicked Aleman out. L.M.C. stated that since then, he had not seen Aleman at the trailer.

Officer Larson did some looking and found the search warrant was executed on 1/25/19. While still at 130 Kelley Rae Road, Officer Larson also spoke with another resident of 130 Kelley Rae Road, D.R.B.. D.R.B. also gave a recorded statement which will be attached to this incident. D.R.B. also stated Aleman had been kicked out since the search warrant, and Aleman had been there approximately two days after the search warrant to pick up his things.

Officer Larson returned to the office and saw he had a voicemail from Aleman. Officer Larson called Aleman back, and Aleman stated he was still living at 130 Kelley Rae Road but was in the process of moving to his sister's house. Aleman stated to Officer Larson that he still goes there every day but had not been getting along with his cousin's significant other, and he and his cousin had been fighting in the recent past. Aleman's cousin is the owner of the trailer, K.A.O..

Officer Larson returned to 130 Kelley Rae Road on 2/20/19 and got a recorded statement from K.A.O.. K.A.O. stated to Officer Larson that since the search warrant for stolen property that occurred at her residence due to Aleman, in which K.A.O. stated the stolen property was found, she kicked Aleman out of the residence, and he returned two days later to gather his belongings. K.A.O. said the only time Aleman had been back at the residence was to pick up mail, and he was only there for approximately 10 minutes. K.A.O. stated that even while Aleman was, “Living,” at her residence, he was not actually living there. K.A.O. stated Aleman had slept at her residence for approximately a week, and after that, he would show up early in the morning every few days, shower, and grab a couple things for work, and then they would not see him again for a few days.

Defendant is on probation and did not report the change of address when he met with his agent, Cameron Behm, on February 11, 2019 and told the agent he was still residing at 130 Kelley Rae Road.
