Probable Cause

On 5-17-23 Investigator Palcher received a child protection intake report about possible criminal sexual conduct and physical abuse that had occurred to an 11-year-old female, fully identified in police reports and referred to herein as Child A. A forensic interview was scheduled for Child A on 6-15-23 at 1000 hours at the Family Advocacy Center of Northern Minnesota. During the forensic interview Child A identified that she had previously resided with her mother and her mother's boyfriend at an address located on South 8th Street in Brainerd, Crow Wing County. Child A identified the boyfriend as Donald Joel Aleman, Jr, dob 10-27-87, defendant herein. Child A reported that over a period of months defendant "raped" her while her mother was at work. Child A specified that these acts occurred multiple times between about the winter of 2020 through October 2021. Child A reported that defendant would sexually assault her when they were home alone, and her mother was at work. These acts would occur in her mother's bedroom, on her bed. Child A specified that defendant would remove her clothing and he inserted his penis into her vagina and anus. Defendant told Child A to "pinky swear" to not tell on defendant. At one point in October of 2021 Child A disclosed to her mother some of what the defendant was doing to her. After this occurred defendant apparently found out that she disclosed against him, and he then assaulted her with a belt. The acts of criminal sexual conduct then ended. Defendant is a level 2 registered predatory offender with a history of sexual assault against juvenile females.

On 6-15-23 officers met with defendant at his residence on Pine Street in Brainerd. Defendant was found to be in violation of his felony parole, caring for a one-year-old female child at the home unsupervised. A Department of Corrections warrant was to be issued for defendant. Defendant was arrested without incident and transported to the Crow Wing County Jail. Defendant declined to provide a statement.
