Probable Cause

On April 17, 2024, at approximately 10:36 a.m., Deputy Dan Schad was dispatched to the intersection of Oakridge Road & Thiesse Road in Brainerd, on report of a suspicious vehicle. The reporting party (fully identified in law enforcement reports), reported seeing the driver “slumped over” in the driver's seat while parked at the stop sign on Oakridge Road. Deputy Schad responded to the location and observed the suspect vehicle parked at the intersection of Oakridge Road and Thiesse Road in Brainerd, the Crow Wing County, Minnesota. Deputy Schad observed the driver, who was later identified as Mikayla Hace Meyer-Brewer, DOB: 03/10/1993, the DEFENDANT herein, “slumped over” in the driver’s seat, with her head resting on the steering wheel. Deputy Schad parked behind the vehicle and observed the vehicle was running and the windshield wipers activated, although not currently raining.

Deputy Schad approached the vehicle and spoke with DEFENDANT. Deputy Schad advised her of the complaint and DEFENDANT told him she was a “tree trimmer” and was looking at the stump in the ditch trying to figure out who owned the nearby property. DEFENDANT appeared confused and lethargic, and Deputy Schad observed that she had dilated pupils, bloodshot eyes, and droopy eyelids. Believing DEFENDANT was under the influence of a controlled substance, Deputy Schad asked DEFENDANT to exit the vehicle to perform field sobriety testing. DEFENDANT initially refused, so Deputy Schad opened the door and advised her to exit the vehicle. At that point, Deputy Schad observed a tourniquet and Q-tips in the driver's door compartment.

Deputy Schad asked DEFENDANT about drug use and she admitted to using methamphetamine “hours” earlier and to having methamphetamine in her bra. Deputy Schad asked DEFENDANT to remove the items and place them on the dashboard of the vehicle. DEFENDANT removed a container with a crystal-like substance inside, and two glass pipes containing white residue.

Deputy Schad administered field sobriety tests and during the tests, DEFENDANT showed several indicators of impairment. DEFENDANT also submitted to a Preliminary Breath Test (PBT) which showed a blood alcohol concentration of .000.

DEFENDANT was placed under arrest for driving while under the influence of a controlled substance and her vehicle was searched. Deputy Schad located a pink pouch on the passenger floorboard that contained several baggies of a white crystal-like substance inside, several tourniquets, hypodermic needles, Q-tips, and torch lighters throughout the vehicle. In the bed of the truck, Deputy Schad located an “emergency response” bag containing several pistols. The substance in the largest baggie in the pink pouch was later field-tested and showed positive for methamphetamine, which is a schedule II controlled substance. This baggie weighed approximately 3.3 grams with packaging.The baggie located on DEFENDANT'S person weighed approximately .4 grams. The remaining baggies were also weighed and the combined weight was approximately 11.2 grams with packaging.

DEFENDANT was read the Miranda Warning and agreed to speak with Deputy Schad. DEFENDANT stated that all of the items in the vehicle belonged to her, and that she had inherited the pistols from her deceased father.


Deputy Schad applied for and obtained a search warrant for DEFENDANT’s blood or urine and then transported her to a local hospital, where the search warrant was executed and a blood sample was collected. DEFENDANT was then transported to the Crow Wing County Jail, where she remains in custody.
