Probable Cause
On October 7, 2021, at approximately 2304 hours, the Crow Wing County Sheriff’s Office was dispatched to the Cozy Bay Resort, located in Crow Wing County, State of Minnesota, regarding a report of a shooting complaint. The initial complainant, K.W.S., reported hearing numerous gunshots coming from the adjoining cabin. K.W.S. reported that he was in cabin 4 at the Cozy Bay Resort and the shooting was heard both inside and outside of cabin 5.
It should be noted that “Cabin 4” and “Cabin 5” are two separate units in a single building. K.W.S. then reported that he had fled from the cabin, away from the gunshots. Two other people called 911 after hearing the gunshots and made reports.
Responding law enforcement located the suspect across the street from the Cozy Bay Resort, near the Mollie Lake RV park at approximately 2322 hours. The suspect was observed him to be carrying a rifle and also in possession of a handgun. The suspect was later identified as Cameron Jay Moser, DOB 3/12/1992. While on scene law enforcement officers had verbal contact with Moser for approximately 90 minutes during which time Moser was in physical control of both an “AR” style rifle and a silver revolver, having both firearms in his hands while speaking to law enforcement. During this contact Moser was able to make his way back to the east side of County Road 4 just to the south of the cabins located at Cozy Bay Resort.
At approximately 0050 hours on October 8, 2021 Moser was taken into custody. The firearms in his possession were secured pending a search warrant. The firearms were identified as a Smith and Wesson semi-automatic “AR Style” rifle believed to be a .223/5.56 and a silver in color smith and Wesson large caliber revolver. Moser also had an extra magazine for the rifle on his person. Moser had also been wearing jeans, a cutoff black t-shirt, a baseball cap, and snakeskin boots at the time of his arrest. M.M.N. had also been staying in a cabin at the Cozy Bay Resort and was interviewed. M.M.N. recalled, after she heard gun shots fired, she looked outside and observed a male walking outside around who was wearing a black cutoff t-shirt.
After Moser was taken into custody members of the Crow Wing County Tactical Response Team (TRT) went to check the cabins near the location of the original shooting complaint. While doing so, TRT member Investigator Phil Stanley approached the front door of cabin 5 and observed the interior entry door to be open, with the exterior glass storm door to be closed allowing him to see inside of the residence from standing outside the storm door. From that position Inv. Stanley observed the door opened into a small hallway that opened up into a large room approximately 10‐15 feet from the entry door. Inv. Stanley observed an individual lying on the floor at the end of the hallway with a large pool of blood under the individual’s head. The individual’s face was not visible, but the individual appeared to be a female. Inv. Stanley also observed what appeared to be two bullet holes in a second entry door that opened up on to a deck on the south side of the residence. Inv. Stanley believed the victim had suffered a gunshot wound based on his observations.
Inv. Stanley and other TRT members entered the residence to check the status of the victim and to check for any other injured parties. In doing so, Inv. Stanley observed a large amount of apparent blood, tissue and bone matter surrounding the victim. Based on these factors Inv. Stanley checked the victim and determined her to be deceased. No other victims were located in the residence. Inv. Stanley and other TRT members left the residence and the residence was held and monitored pending a search warrant.
Directly outside the front door of the residence Inv. Stanley observed a blue 2013 Toyota Rav4 which was registered to Bethany Anne Bernatsky, the decedent in this matter. No other vehicles were located in front of cabin 5.
Law enforcement from the Crow Wing County Sheriff’s Office and the Minnesota Bureau of Criminal Apprehension (BCA) conducted a crime scene investigation pursuant to a search warrant executed on the same day. The BCA Crime Scene Team located shell casings in cabin 5 that were of the same caliber and brand of the ammunition in Moser’s rifle.
The deceased female was ultimately transported to the Ramsey County Medical Examiner’s Office (RCME) for an autopsy. There the deceased female was identified as Bethany Anne Bernatsky by the RCME through a tattoo on her body that was known to be there by a family member. The RCME issued a provisional report which determined the manner of death to be a homicide and the cause of death to be multiple gunshot wounds. Bernatsky suffered multiple gunshot wounds to her body, including one to her head.
It was learned that Moser had familiarity with the Cozy Bay Resort as he used to have a relationship with the previous owners’ daughter, M.J. Moser had presented at Mollie Lake RV Park the previous week asking about M.J. |
