Probable Cause
On September 19, 2022, law enforcement began investigating an allegation that Child A (fully disclosed in police reports), with a date of birth in March of 2007, may be a victim of sexual abuse. On September 29, 2022, Child A was interviewed at a child advocacy center. Child A stated she lives with her family in the State of New York. Starting on approximately August 24, 2022, her family stayed at a cabin on Battle Point Road in the City of Deerwood which is located in Crow Wing County, State of Minnesota. Child A was 15 years old at the time. Another person staying at the cabin was Kyle Preston Garrow, DOB: 02/06/2002, hereinafter defendant. Child A stated that on August 29, 2022, the defendant sent her a message on social media asking if she wanted to "cuddle". Later that night, the defendant crawled into the bed she was sleeping in. The defendant asked her if he could touch her. Child A stated she was scared and did not know what to say. The defendant was 20 years old. She told him she did not know. The defendant touched her on her breasts and buttocks with his hands over her clothes. The defendant also asked if he could touch her under her clothes. The defendant then touched her on the bare skin of her breasts and buttocks with his hands. The defendant ultimately got up and left.
Law enforcement interviewed ASD (fully identifed in police reports). ASD stated she is best friends with Child A. ASD stated that the defendant is her cousin. On August 29, 2022, she was sleeping at a cabin in Deerwood, MN. She observed the defendant crawl into the bed Child A was sleeping in. ASD then fell asleep. The defendant later woke her and told her he was leaving.
Law enforcement also interviewed ESP (fully identified in police reports). ESP is the aunt of the defendant. On approximately September 2, 2022, she received texts from the defendant. He stated that he "fucked up" and ESP was going to be mad at him. He had slept in the same bed as Child A. He admitted that he touched her breasts and butt. He said he asked for permission to touch her breasts and butt. She said she said she didn't care so he thought it was okay.
The defendant declined to give a statement.
