Probable Cause
On July 9, 2015, Breezy Point City Police Officers responded to a residence based upon a domestic incident involving C.D. and Michael Lowell Munger, the above-named defendant. Officers arrived and separated the parties for the evening. C.D. then applied for an Harassment Restraining Order against the defendant and received an emergency order as more fully reflected in District Court File No. 18-FA-15-2776. A hearing was scheduled on the emergency restraining order but the defendant did not appear and had not been served with the emergency order.
On July 13, 2015, C.D. reported that she had received threatening text messages from the defendant and contacted the Breezy Point Police Department. Officer Joe Garcia was able to make contact with the defendant on his cell phone. Officer Garcia asked the defendant where he was. The defendant indicated that he was in Seattle, WA but would not give an address.
On July 15, 2015, Pequot Lakes Officer Kate Petersen was asked to contact C.D. at her place of employment in Pequot Lakes, Crow Wing County, Minnesota. Officer Petersen made contact with C.D. who said that the defendant had just called her at work and threatened her. A coworker answered the phone and the defendant requested to speak with C.D. When the coworker handed the phone to her, the defendant told C.D., "I don't care about your restraining order. I'm going to kill you." C.D. said that the defendant then repeated, "I'm going to kill you" and hung up the phone.
Officer Petersen conducted a cell phone search and determined that the call had come from a cell phone listed to the defendant's sister who lives in Bellvue, WA. The defendant's sister's call log showed a call to C.D.'s place of employment on 07/15/2015 as C.D. had reported.
On July, 16, 2015, Officer Petersen received a voicemail from C.D. who indicated that she had received two phone calls that morning which she believed were from the defendant. She indicated that she answered the phone and all she heard was someone breathing on the other end. Officer Petersen contacted the cell phone carrier and was advised that calls had been placed to C.D.'s cell phone from the defendant's sister's cell phone. It also indicated that the calls came from the Seattle, WA area.
Based upon information and belief, a suspicious male was observed in the area of the defendant's residence but ran away when he was seen by C.D.'s child. After the male ran away, it was discovered that a can full of gasoline had been left at C.D.'s residence. It is believed that the person who left the gas can is the defendant.
The defendant's whereabouts are currently unknown and your complainant requests that a warrant issue. |
