Probable Cause
On June 19, 2016, at approximately 0744 hours, Minnesota State Trooper Nick Otterson was on routine patrol travelling east on Minnesota Highway 210 near County Road 12 in Irondale Township in the County of Crow Wing, State of Minnesota, when he observed a vehicle travelling towards him. Trooper Otterson observed that the front seat male passenger was not wearing a seatbelt, and that there was an object hanging from the rearview mirror. Trooper Otterson turned to follow the vehicle, and noted the vehicle was travelling visually fast and pulling away from him. Trooper Otterson activated his radar, and clocked the vehicle travelling 63 MPH in a 60 MPH zone. Trooper Otterson activated his emergency lights, and performed a traffic stop on the vehicle.
Trooper Otterson made contact with the female driver, Megan Marie Doering (DOB 8/29/1993), and the male front seat passenger, Dakota Troy Anderson (DOB 5/29/1991). Trooper Otterson requested identification and proof of insurance from Doering and Anderson. Doering could not find insurance information in the vehicle. Doering indicated they were coming from visiting a friend in Crosby. While speaking with them, Trooper Otterson noted both individuals had dilated pupils and bloodshot/watery eyes. Both individuals had numerous open sores on their faces, legs and arms. Anderson would not make eye contact with Trooper Otterson, and was staring straight ahead as if he were not there.
While speaking with both occupants, Trooper Otterson observed a green torch lighter at the feet of Anderson. Trooper Otterson also observed a used Q-tip in the glove box as Doering opened it quickly to look for insurance information. Trooper Otterson had Doering step from the vehicle and sit in his squad to complete the business of the stop. While speaking with her, Trooper Otterson noted she would not make eye contact with him, and that her story changed as to where they were coming from.
Trooper Otterson learned that Anderson had 3 body only warrants for his arrest. Anderson was taken into custody and placed in the rear of Trooper Otterson's squad car. Trooper Otterson asked Doering if there was anything illegal in the car, and she stated, "Not that I know of." Based on the indicators he had noted, Trooper Otterson had his narcotics dog Busa perform a sniff around Doering's vehicle. Busa did a narcotics "hit" on the vehicle.
Trooper Otterson then performed a search of the vehicle. Located on the floor at the base of the Anderson's seat was a small brown bag. Next to the bag was a used methamphetamine pipe. Inside the bag was a replica BB gun, a green straw used to snort narcotics, and a prescription bottle for Hydrocodone with Anderson's name on it. Underneath Doering's seat was a blue zippered pouch. In the pouch were new unused drug baggies, a used digital scale with residue, a 100 gram weight, and a small baggie with a light brown powder. This powder later tested positive as heroin, and weighed 0.25 grams.
In the center console was a pack of Newport cigarettes. Trooper Otterson opened the package, and observed multiple packages of a crystalline substance. This substance later tested positive as methamphetamine, and weighed 7.0 grams. Another baggie with a crystalline substance was later located on Anderson at the jail, and weighed 1.1 grams. |
